General :
These general terms and conditions regulate the reciprocal rights and obligations between the camping guest and Camping Willam.
With the registration or booking, the guest agrees to the terms and conditions, the currently valid price list and the site regulations. At the same time, he also assumes liability for the persons accompanying or visiting him. Telephone information, ancillary agreements and other assurances of any kind must be in writing to be effective and are only part of the contract if confirmed in writing by the campsite.
The camping guest is obliged to register visitors at the reception before entering the campsite. He must ensure that the fee is paid at reception according to the valid price list.
The subletting or subletting of parking spaces and rental accommodation and their use for purposes other than accommodation are not permitted.
The stay of young people under the age of 18 is only permitted if accompanied by a legal guardian.
The instructions of the administrative staff, especially with regard to the setting up of motor vehicles, caravans, mobile homes and other vehicles as well as tents, must be followed without restriction and immediately.
In the event of violations, the campsite operator reserves the right to refuse to accept people or to expel guests or visitors from the site. The campsite operator exercises the domiciliary rights.
The general road traffic regulations apply on the campsite.
Ticketing :
The basis for the conclusion of the contract is the guest's booking, which is subject to payment. The camping contract is only effective with written confirmation of the contract by the campsite for the specified period and for the registered persons.
There is no entitlement to be allocated a specific place or specific area. Place requests will be considered if possible.
Bookings by persons under the age of 18 traveling alone are not permitted and will be cancelled. Likewise, bookings made by people who have already been banned from taking up space will be cancelled.
Booking conditions for pitches:
Pitch bookings are possible in the low season from 4 nights and in the high season from 6 nights. A deposit of 30% is due upon receipt of the booking confirmation. The arrival and departure dates stated in the respective booking confirmation are binding. The booked stand is available from 2:30 p.m. on the day of arrival. For stands that are not occupied by 6 p.m. on the day of arrival and for which no agreement has been made about later occupancy, the parking space booking expires. In this case, we reserve the right to assert claims for damages. The same applies to places that become free due to early departure. A pitch change is only permitted with the prior approval of the reception. The pitch must be vacated by 11 a.m. at the latest on the day of departure.
Booking conditions for rental properties:
The minimum rental period is 7 nights. Shorter rental periods are possible on request. For 1 or 2 nights, a short-term surcharge will be charged. A deposit of 50% is due upon receipt of the booking confirmation. The remaining payment is due 14 days before arrival.
Rental accommodation is available from 3 p.m. on the day of arrival and must be vacated by 10 a.m. on the day of departure. The following cleaning work is to be carried out by the guest: empty the fridge and rubbish bin, dispose of rubbish and leave it swept clean. Smoking is not allowed in the rental accommodation. Pets are not allowed.
Rebookings and cancellations:
Rebookings or contract changes are possible by arrangement.
The campsite is entitled to withdraw from the contract for an objectively justifiable reason or to terminate it without notice, especially if force majeure or other circumstances for which the campsite is not responsible make it impossible to fulfill the contract, e.g. if pitches or rental accommodation are culpably provided with misleading or false information or withholding essential facts. The campsite is entitled to terminate the contract without notice for good cause if the campsite guest culpably violates the campsite regulations, endangers others, causes lasting disruption, uses the pitch or rental property in breach of contract or otherwise behaves in a grossly non-contractual manner. The verbal request to clear the site management is sufficient for the immediate termination of the camping contract. In this case, the camping guest is not entitled to a refund of the rent.
In the event of a withdrawal from the contract by the camping guest, the following fees apply:
Cancellation of a holiday pitch:
If a holiday pitch is canceled up to 10 days before arrival, the deposit will be refunded. In case of cancellation within 10 days before arrival or non-arrival by 6 p.m., the deposit will be retained. The withdrawal must be made in writing in any case. We recommend travel cancellation insurance. In the event of early departure, the remaining days booked will be charged at 50%.
Cancellation of rental accommodation:
If a rental accommodation is canceled up to 1 month before arrival, the deposit will be refunded. If you cancel up to 14 days before arrival, the deposit will be retained. In the event of later cancellation, non-arrival or early departure, there will be no refund. The withdrawal must be made in writing in any case. We recommend travel cancellation insurance.
All transfer costs (bank charges) for any payments are borne by the booking party guest to carry. Costs that are charged to us for international transfers are without exception billed to the booking guest.
Payment :
The prices to be paid by the camping guest result exclusively from the price lists of the campsite valid at the time of booking. All prices quoted include the currently valid VAT rate. If a VAT rate increases, for example if tax-free sales become taxable, we make use of our right to compensation. The prices stated in the price list correspond to the status at the time of printing. We reserve the right to change prices and services. We also reserve the right to correct errors, misprints and miscalculations.
When claiming discounts, only the highest discount rate applies. An accumulation of several discounts is excluded. A discount card recognized by the campsite must be issued at the time of booking and presented in the original upon arrival. A subsequent recognition of the discount is not possible.
Payment is made during the opening hours of the reception on the day of departure or 1 day before plus additional costs. Payments can be made in cash or with an EC card. Credit cards are not accepted.
For guests who use the off-season offer or guests who have booked a pitch for more than 4 weeks, an interim statement must be made at the end of each month.
Liability :
The campsite's contractual liability is limited to damage resulting from the breach of a guarantee or from injury to life, limb or health and damage caused by the campsite, its legal representative or its vicarious agents intentionally or through gross negligence. The campsite is only liable for slight negligence if essential obligations are violated which arise from the nature of the contract and which are of particular importance for the achievement of the purpose of the contract. In the event of breach of such obligations, delay and impossibility, the campsite's liability is limited to such damage that is typically to be expected within the framework of the contract.
The campsite is not liable for damage caused by the failure or disruption of water, electricity or gas supplies, for noise pollution by third parties or for negligent breaches of duty resulting in damage caused by the use of the facilities and equipment on the site and devices are created. Likewise, there is no liability for damage, accidents, losses or other irregularities that arise in connection with the use of the camping and boating area. In the event of defects, the camping guest is obliged to notify the campsite management immediately in writing. If this notification is omitted, the camping guest is not entitled to any claims, regardless of the legal reason. Each guest assumes liability for the use of animation, childcare, the playground and all sports fields. Swimming in the lake is at your own risk. There is no lifeguard.
Insofar as liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the campsite. Influencing by force majeure excludes liability.
Data protection :
The guest agrees that his personal data recorded by us in the context of customer service will be stored in our computer system and processed automatically. Both contracting parties will observe the relevant provisions of data protection both during the term of the contractual relationship and after its termination.
Jurisdiction :
German law applies exclusively between the camping guest and the campsite. The place of performance and payment as well as the exclusive place of jurisdiction is the headquarters of the Willam campsite.
